Terms of Service

Please read these Terms of Service ("Terms") carefully before using the eVidyaKosh platform (the "Service") operated by CSC Mahadev Tikar, Proprietor: Santosh Kumar, located at Mahadev Tikar Sadipur, Pirpainti, Bhagalpur, Bihar 813209, India (GSTIN 10HNCPK9403H1Z9) ("us", "we", or "our"). By accessing or using the Service, you agree to be bound by these Terms. These Terms are governed by the laws of India, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019.

1. Accounts & Registration

When you create an account, you must provide accurate and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

2. User Roles & Responsibilities

Our platform supports the following user roles, each with specific responsibilities:

• Students: Access study materials, book live tutoring sessions, manage wallet balance, and report errors for rewards. Students must not share, distribute, or reproduce any content from the platform.
• Educators: Provide live tutoring sessions, set schedules and hourly rates, and earn through the platform. Educators must provide accurate qualifications and maintain professional conduct during sessions.
• Content Editors: Create, edit, and manage educational content. Editors must ensure content accuracy and originality.

3. Wallet, Payments & Transactions

• Students can add funds to their wallet via our supported payment gateways — Paytm, PayU, Cashfree, and PhonePe (UPI, cards, net banking). Wallet balance is used to book live tutoring sessions and access premium features.
• All payments are processed in Indian Rupees (₹) through PCI-DSS compliant payment gateways regulated by the Reserve Bank of India (RBI).
• Wallet balance is non-transferable between users. Refunds of wallet balance are subject to our Refund Policy.
• We reserve the right to reverse fraudulent or erroneous transactions.

4. Educator Payouts

• Educators earn through live tutoring sessions. Earnings are credited to their platform wallet after session completion.
• Platform Service Fee: eVidyaKosh charges a transparent platform service fee (commission) on withdrawals to maintain the infrastructure. This is a platform service fee covering payment processing, escrow, and payout costs. The fee percentage decreases for larger withdrawal amounts.
• Verified Educators: Withdrawal requests are processed within 48 hours (excluding bank holidays).
• Unverified Educators: Withdrawal requests may take up to 7 working days for additional verification.
• Educators are responsible for their own tax obligations under Indian tax laws.

5. Report & Earn Program

Users can report errors in educational content. Each approved report earns a reward credited to the user's wallet balance. We reserve the right to accept, reject, or modify reward amounts for reported errors. Fraudulent or duplicate reports will result in account suspension.

6. Intellectual Property

All original content, features, and functionality of eVidyaKosh are the exclusive property of CSC Mahadev Tikar and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of India.

• You may not copy, reproduce, distribute, modify, or create derivative works of any content without prior written permission.
• Content created by editors remains the intellectual property of eVidyaKosh upon publication.
• Screen recording, downloading, or scraping of platform content is strictly prohibited.

7. Prohibited Activities

• Using the platform for any illegal or unauthorized purpose.
• Sharing account credentials or allowing unauthorized access.
• Uploading malicious code, spam, or inappropriate content.
• Harassment or abuse of educators, students, or staff.
• Manipulating the wallet system, payment gateway, or Report & Earn program.

8. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for violations of these Terms. Upon termination, your right to use the Service ceases immediately. Any pending wallet balance may be forfeited if termination is due to policy violations.

9. Limitation of Liability

To the maximum extent permitted by Indian law, eVidyaKosh shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

10. Dispute Resolution

Any disputes arising from these Terms shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The seat of arbitration shall be Bhagalpur, Bihar, India, and the language of proceedings shall be English or Hindi. The courts of Bhagalpur, Bihar shall have exclusive jurisdiction over any matters not covered by arbitration.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 15 days prior to taking effect, in compliance with the Consumer Protection Act, 2019.
